THE MALAWI COMMUNICATIONS ACT

The Malawi Communications Act was passed into law by Parliament in November 1998. The Act puts in place a legal framework for:

  1. the regulation and provision of services in the Communications Sector in Malawi comprising:
  2. the establishment of an independent regulatory authority, the Malawi Communications Regulatory Authority (MACRA)
  3. the restructuring of the Malawi Posts and Telecommunications Corporation (MPTC) into separate telecommunications and postal business
  4. privatisation of the telecommunications business
  5. the separation of the administration and provision of telecommunication services from postal services;
  6. the reconstitution of the Malawi Broadcasting Corporation (MBC) as a public broadcaster;
  7. and matters connected therewith or ancillary thereto
The Act replaces the Malawi Posts and Telecommunications Act (No. 29 of 1994), the Malawi Broadcasting Corporation Act (Cap. 20:01) and the Radio-communications Act (Cap. 68:02).

A Malawi Communications Sector Policy Statement was also released by the Malawi Government in 1998 to outline the Malawi Government Policy for the development of the country's Communications Sector, covering broadcasting (both radio and television), telecommunications and postal services.

A memorandum on the Communications Bill as presented to Parliament in October 1998 summarises the Communications Act.
